Legal Question in Personal Injury in California

i was stopped at a red light when i was hit behind. we exchanged information and the police were called unfortunately they were not responding to non injury accidents. the insurance company was called and they have not been able to contact there insuree via phone or mail. since then the insurance company has refused to pay my claim because they have been unable to reach him. i have filed small claims and the sheriffs went to serve him i received my paperwork from the server stating that he is a minor..... what do i do

You should just file a claim with your own insurance company and let them deal with collecting from the other insurance company or the minor.
