Struck by an Automobile- What should I do?

Along with 2 other of my friends this evening, I was struck by a woman going approx. 35 mph on a 4 lane- 2 way road in San Francisco. We were walking in the crosswalk, and were struck, then thrown about 20 feet. Injuries are yet to be confirmed, but pain is worsening. (Internally) The police gave 100% fault to the woman driving. I would most of all like to know what our rights are, and what we should do. Should we seek a lawyer's assistance? Thank you for any help you may provide.

You and your companions are entitled to recover reasonable compensation for your losses. This includes reimbursement for medical ecpenses, loss of earnings, property damage and pain and suffering. You should at least arrange a consultation with a lawyer in your area. Consultations are usually free. If you need a referral to someone close to you let me know or call for a phone consult with me.

There is no question that you need to retain counsel, as do your two friends. The sooner you do so the more control you will have over the process. Be careful not to speak with the potential defendant's insurance carrier representative and be careful not to give any recorded or written statements. It is unclear if all three of you were hit by this car and it is unclear what injuries were suffered. I am truly sorry to hear of your accident. I certainly hope that you have a full recovery.

My first recommendation would be for you to seek medical assistance, if you have not done so already. Second, keep all documents associated with the incident (medical bills, photographs, police reports, etc.) in a safe place. Finally, seek legal representation to preserve your rights.

I am also sorry for the accident. I agree with the advice from the first attorney. TAKE PHOTOS to preserve the incident. Photos of the car, injury, etc. will all end up being helpful. We do many cases similar to yours... go to a good doctor and check all the injuries and keep a paper trail of everything... please let me know if I can help w/ anything

It sounds like a most unfortunate matter. It may effect your walking or running. If this is a disfiguring injury that may effect your gate, then you may need to demand more than the policy limits. Lost earning capacity, medical bills, future medical costs, and, pain and suffering are awardable. You need to obtain representation immediately so as to have the insurance company set the reserve at the hightest level.
