vehicle Damage at Work

The parking spaces at my have those small cement curbs to keep you from pulling into the space in front of you. The other day when I was backing out of a parking space a piece of rebar that is used to hold the cement curb in place was sticking out of the top of the curb a couple inches and caught the front of my car. Ripping the the lower part of my bumper in half. Is my employer responsible for the repair bill? Would I have a case in small claims court if they refuse to pay?

Liability MAY lay on the owner of the lot where you parked your car. Whether or not you can win a suit depends on how long the problem existed, how quickly (slowly)the owners reacted to fixing the problems as well as your own actions of parking in that spot. If you had prior knowledge that the cement was missing, then the fact you parked there may negate any liability.

In otherwords, a lot more analysis is needed before any opinion can be given.
