This sort of situation really requires an in-person meeting to go through all the facts. One single question and one single answer can't possibly explore every aspect of the case. Based on what you asked, the simple answer is "talk to an attorney." It's free, so there's no reason not to call. More specifically, though, you are looking at maybe having to sue the other person in this accident. If the insurance company is denying, you need to understand why, so that you can know what your chances are in litigation, and also so you can know if it's worth the effort. I need to review your insurance policy, correspondence, and maybe write a letter. I have handled similar situations where a letter from me resulted in an insurance payout.
