riding lawn mower started fire

just bought riding lawn mower from lowes it was $2500 2 mos. old brother was mowing field and it burst in flames and burnt diabled brother s leg not real big burn but 2nd degree burn our land a few acres of our land burnt and a tree my fire inspector says it was fault of lawn mower cause there was no spark arrester on it its required by law to have it in ca. he looked at manual and it says nothing about it he called lowes pretending to want to by a lawn mower ask ed if they have spark arresters on them and lowes person said not required in ca. fireman asked if they sell spark arresters there man said no lawn mower is totally melted and fireman documented all that was said do you think we have alawsuit? theres more please let me know thankyou
