Legal Question in Real Estate Law in California

Bought a home with previous partner as joint tenants in common. She stopped paying in 8/13 and I moved to an apartment due to her abuse. She still occupies the house but I want to catch the mortgage up before foreclosure and take back the property. How can I make her leave before it is too late and live in my home?

You either hold title as joint tenants or as tenants in common. You can't be both. I suggest you iron out that detail first. You cannot have a co-owner evicted from a house, and if you are a cosigned on the loan, you can make payments any time you want.
