Brown Act

Does the Brown Act apply to small private homeowner's associations or does that fall under the states Civil Code?

Re: Brown Act

The Brown Act only applies to governmental entities. While HOAs sometimes act like mini-governments, the Brown Act does not apply to them.

HOA meeting governed by a law called the Common Interest Development Open Meeting Act, which is located at Civil Code ยง1363.05. It shares some features of the Brown Act, but you need to read the law for yourself or consult a local attorney for further information and advice.
