Legal Question in Real Estate Law in California

I have an easement on my property to access a well that has been destroyed many years ago. The deed creating the easement states the easement should terminate with the well. We were able to find the original trustee he is ok to sign a quitclaim but he won't sign an "affidavit of trustee death" (his co trustee passed many years ago). What can we do?

Without researching your situation and needs, I'd say get and record the quitclaim, but be prepared, if it ever becomes necessary (such as for a lender or purchaser), to file and prosecute a "suit to remove cloud from title".
