Technically you are as you are getting somewhat less than what you bargained for in renting the unit. The issue is how much is that loss worth. More importantly, if your landord has basically good thusfar, why irriate him when he can raise your rent as much as he wants, unless you are under rent control, when ever the lease expires and he can also give you a thirty day notice to leave.
