Legal Question in Real Estate Law in California

Can a fellow roomate who is on the lease legally kick me out of our house where I have been living for over 6 months? He gave me a verbal eviction notice of 1 month. I am not on the lease and pay month to month to the roomate in question. We live in San Diego Ca.

There is no distinction made between verbal and written leases or sub-leases; notices ending a rental must be given in writing. The master leasee [your roommate] must follow all the rules that the landlord must follow as to the master leasee. So it would seem the eviction is illegal. But once you inform him/her of that, they probably will just then give you a written notice of termination, so all you gain is a sight delay in having to leave. Check with the City if they have any tenant protection laws but I believe San Diego does not.
