Legal Question in Real Estate Law in California

Hello,

I live in Los Angeles, CA and bought a house in Columbus OH. I am trying to do a loan modification and the agency that was helping me didn't do the right job and I received a "Summoms" my house is in forclosure and I have 28 days to reply to the summons. Do I need an attorney to reply to the summoms and since the house I am buying is in the state of OH do I need to hire an OH attorney? Or since I live in CA can a CA attorney help me?

Thanks,

Irma

If the Summons was from Ohio, you need an attorney in Ohio.

In California, a "summons" does not issue in a non-judicial foreclosure, so Ohio law probably is different from California, so you definitely would need an attorney in Ohio. Also, the lender is more likely to pay attention to an attorney in the state where the legal proceeding are occurring then an out of state one.

It sounds like Ohio is VERY different from California in this area of the law. Find an OH attorney.

Your attorney should be licensed to practice in the state of the court where the suit is filed.
