Legal Question in Real Estate Law in California

Hoa

The only board member on our HOA who has desperately been trying to make the rest of the board members, management and legal comply with civil code (releasing budget regularly, insurance policy info, etc,) has been quite frustrated and out of that frustration may or may not have breached his fuduciary duty by releasing executive board information, (but no legal invoices) ...can they legally make him leave the board? If they do make him leave can he run again. If he resigns, before any action taken against him can he can run again.

Re: Hoa

Can't answer these questions without reviewing the CC&R's, Bylaws and Minutes of Board meetings. This requires time and attorneys get paid for their time. Therefore, if it is important enough to pay for a review, that is what will be required.
