Legal Question in Real Estate Law in California

The HOA From Hell

Back in late September/early October of 2005, I sent a personal check for October's dues ($2,000 + the regular assessment; there was a vote earlier this year for an additional $2,000 assessment for repairs/improvements to the units/common area, according to them the vote was yes, so everyone was charged WITHOUT confirming anyones financial status, claiming all of a sudden it was the resident's responsibility to maintain their unit ; the bylaws were conveniently changed also to reflect this.) An extra $150 was also assessed to paint my fence, which was FORCED also, either paint your fence or we'll have someone paint it for and charge you. Their reasoning the other condos/townhouses in the area are better maintained, apparently the HOA is in debt and we are being forced to make up for it. Anyway, I sent in my check , they sent it back on October 20, WELL after the due date, because I forgot to sign it, since the due date had passed, I was assessed a late fee. I do not feel that this is any fault of my doing. All these people seem to want to do is complain and try and get as much money out of you that they can, but nothing much else seems to get done, except landscaping. I do not have much money, but any help can be appreciated.
