Legal Question in Real Estate Law in California

Home Based Business Trespassing vs Home Trespassing

Hofe I am in the right area of law...

I have a licensed home based business. I have had problematic guest come over during my home business hours. Is there a difference between trespassing on a home based business (property) and home/house trespassing ( non business hrs? How do I file a complaint ?

Re: Home Based Business Trespassing vs Home Trespassing

There is no trespass until the moment you ask the patron to leave and he refuses. If he entered as a guest the initial entry was not a trespass. The complaint begins with the police department.

Re: Home Based Business Trespassing vs Home Trespassing

There should be no difference between the two. But if the person is a guest there is no trespass. You also do not tell us if they come inside your home, you tell them not to come inside, how they get in [door open for business customers, etc.].

Tell the person not to come and why. Tell them that if they come again you wil call the police. Do not expect the police to do much as they will tell you it is a civil matter unless the person represents some physical danger to others.
