Legal Question in Real Estate Law in California

Home deed

My parents and I are on the deed to our home. My father passed away and my mother and I want to get his name removed from the deed. Are there any tax consequences for doing so?

Re: Home deed

You need to consult with a tax attorney, or a CPA for answers to tax questions, even if they involve real estate.

Re: Home deed

I am sorry to hear of your father's passing. I know it is painful to lose a parent.

In regards to your question:

How were you all on the deed? As co-tenants or joint tenants with the right of survivorship? It makes a diffrence.

Additionally, since your mother is a surviving spouse and you are a child, there are exemptions to a property tax increase that can be used for you both, depending, of course, on how the property is titled.

If you would like to discuss this matter further in a more private forum, please feel free to contact me directly at the email address provided by LawGuru or through our firms website located at PasadenaEstatePlanning.com
