Homestead

i am currently buying a house husband no longer lives there would like to homestead the home do i use the singles homestead form or the married couples form? also once form is filled out and notorized who keeps form on file. county recorders office?

Are you purchasing the home from your husband as part of a divorce proceeding? Or are you already divorced? If you are no longer a married couple and title to the property has been transferred to you, you can file a homestead exemption in your name only. Otherwise, the exemption will need to be filed in the name of the record owners of the property. The exemption is filed with the county recorder in the county in which the property is located.
