Land encroachment

my property has just been re-surveyed because the property next door to me while under construction, the owner smashed the property pin. the property pin has been reinstalled. the side yard property next door is approximately 7 inches on my side of the property line. The owner of the property purchased the property for sale. However, he lost the property to the bank. can i charged the new owner a fee for encroaching on my property. there was a mini-barrier put up by the former owner. the contractor for the bank, tore the barrier down and placed rock pebbles along the front side yard. Now that the property pin has been set, can i charge them a fee for encroaching on my property.

Yes or force them to remove the boundary of the yard or buy the strip of land. However you may have to sue for tresspass in order to force the issue. Contact me directly.
