Legal Question in Real Estate Law in California

Landlord problems

There is black mold throughout the apartment and the walls are falling apart because the roof is leaking into the apartment. It has been over 30 days since notice to landlord and we have been advised not to pay. Landlord (Prop Mgmt Co.) has done nothig and has not returned calls. They called my parents (reference on application) and told them rent has not been paid and they are afraid I am inside and not OK because they can not get into the apartment or reach me. I have a voicemail from 5 days ago from the company saved with their number on my caller ID indicating they spoke to my husband, and we were in the apartment when they posted the three day notice and didnt even knock. They have access to the apartment as they have entered before with a key and lock has not changed. Do I have any recourse?

Re: Landlord problems

Call the building code enforcement department in the city or county in which the apartment is located and complain about the mold. Based on your description of the apartment, at least that apartment should be condemmed and perhaps the entire building. Consult with the individual that gave you the advice not to pay the rent, and ask about an attorney that will represent you in this matter. You may be entitled to a refund on the rent already paid for the apartment.
