Legal Question in Real Estate Law in California

Is it legal for realtors to advertise houses for sale that have been in escrow for more than a month?? I keep calling them on this house and they keep telling me "It's going to close any day now"

Until a sale closes, agents and brokers can solicit and accept back-up offers, but must disclose the fact that the property is "in escrow" or whatever else is factually true and necessary to disclose to such late-arriving prospects.
