Can lender file deficiency judgement after loan modification period.

My loan was once modified for a period of 3 years. This year, my rate is going up, in addition to that, a balloon payment is due this year. I can not pay, neither can I sell the house to make the balloon payment. If I walk away, can lender sue me for a

deficiency judgement?
