Legal Question in Real Estate Law in California

Management Co. Refuses to Return Deposit

I gave the property manager for the management company that rents our house a security deposit of $1,800. The owner of the management company says that the employee stole the deposit and is refusing to return it to me. I just gave the company my 30 day notice and told them to use the deposit as my last month's rent. The owner of the management companys says that he is going to attach my credit. Can he do this without going to court? I really do not want to pay this guy another dime because I will never get back my deposit. What should I do?

Re: Management Co. Refuses to Return Deposit

If the management company acknowledges that you had funds on deposit but the employee stole it, it should not be your problem.

That's why such companies should have insurance to cover employee dishonesty. The company should return your money. If it does not do so, you will have to go to small claims court.
