Neighbor taking photos of my house

I need a letter to go out to my neighbor taking photos of my home. I have a 5 yr old and 2 yr old and am nervous and feeling haraased by them. they think we are doing weekly vacation rentals, which we are not doing, so they are doing these things to harass us.

Re: Neighbor taking photos of my house

Have a lawyer send the letter. You have every right to rent your house to whomever you choose. You say you have no CCRs, why not put up a big sign that says We Support Weekly Vacation Rentals.

Re: Neighbor taking photos of my house

I don't agree with the advice, probably meant humorously, to put up signs of any kind. Further, I don't see your mention that there are no aplicable CC&Rs (??). This situation needs careful de-fusing, not the tossing of additional tinder on the fire.

I handled a case (as a contract attorney) involving allegations of harrassment including taking pictures of the neighbor's house. My recollections of the outcome of that case are incomplete, but I think taking pictures, in itself, is not harrassment that is worthy of an injunction.

I suggest the neighbors here look for ways to chill out and resolve the core issues by negotiation or third-party mediation rather than alleging legal rights against one another.
