In general, the tree owner is responsible for damage done to neighboring property by invading limbs and roots, which are considered to be trespassing. The injured party has a responsibility to use reasonable measures to keep the damages down, such as by getting the problem fixed within a realistic time frame to prevent further harm, and getting competitve bids from licensed contractors with good reputations, etc. If you have good proof of what happened and why, and of your reasonably-incurred costs to remedy the trespass, you have a good chance of winning a

small-claims suit (maximum claim $7,500).
