Legal Question in Real Estate Law in California

Ownership of Home on Joint Tenant Property

I have joint tenancy on a property with two home one of which I live in. The other is rented and the rent goes to the other persons on the deed. I would like to buy a home and rent the home I presently live in. Will I have any problems doing this or once I am out can the other persons on the deed claim rights to this home?

Re: Ownership of Home on Joint Tenant Property

The other person has an ownership interest in the house you live in if you hold it in joint title. Perhaps you can approach him/her and work out an agreement regarding the rents or its sale, since the other person collects the rents from the other home. Also, if you no longer are on good terms with this other person, you might want to change the nature of the ownership from joint to tenants in common. Holding it in joint tenancy means that if you die, then the other person gets full ownership without having to go through probate.
