Legal Question in Real Estate Law in California

Probate to Real Estate Question

I have a perplexing situation. My father passed away over a year ago. Unfortunately, there was no will. In hopes of making my life easier, I hired a probate attorney. As the next-of-kin, I am the sole beneficiary. In more detail, I coming into money, stocks, and a home. This is where things get tricky. My father's home was recognized as an LLC with my uncle. Due to bad relations, I need my interest out of the home. The probate attorney offered his assistance; however, after being paid, I cannot get him to return my messages. Even worse, my probate is not officially done. Also, after a settlement, I cannot reach my uncle or his attorney. Meanwhile, I'm losing money on the property. In more detail, I'm not collecting rent and paying a mortgage. There is an operating agreement that says that the party who cannot come to an agreement regarding the property is liable for attorney fees. What can I do?

You should consult with an other attorney.

Re: Probate to Real Estate Question

I am a real estate attorney but not a probate attorney. The answer that comes to mind is who negotiated the settlement and what does it entail ? If your probate attorney has done nothing, have you tryed to contact him by writing ? I would be happy to write him if you are considering a new attorney.
