Promissory Note -Secured

Do I use a promissory note for the state in which I live or the state in which the real estate that is being used as security is located?

You would want to use state-specific forms. However, a promissory note DOES NOT act to secure a claim against real property (at least in California); hence you will need both a promissory note and a deed of trust specific to California. Unless you know exactly what you are doing, I strongly suggest that you seek the advice and assistance of an attorney whose practice emphasizes real property. The small amount you will pay to have it done correctly will pay for itself many times over.
