Legal Question in Real Estate Law in California

We purchased a tractor/trailer about 2 1/2 years ago. An employee stoled our tractor /trailer which we have now located in Boone, CO. All we want is our tractor /trailer. We do not want the driver arrested. We just want our property. How can we recover our property without a court order? We provided proof of ownership of our tractor /trailer to the locate sheriff's department, however they indicated that this is a civil matter and we would need to address the recovery of our property in court as a civil matter. We do not have the funds to post a bond and pay for legal fees to recover our property ... Please advise...

If you have the proof of ownership, after checking with the local law enforcement agency, go to where the tractor/trailer is located and if safe drive it off, leaving a note that you took it. This is not a civil matter unless the person who took it has some color of title; you should ask that the person be arrested for grand thief auto.
