Legal Question in Real Estate Law in California

Real Estate Broker

What can I do when after a year of begging my broker has failed to provide me with my contract(s) on the first and second refinance of my home which is in foreclosure (10 day notice served). And, furthermore the broker happends to be my Nephew and is no where to be found.

Re: Real Estate Broker

I'm unclear from your post - did he broker the loan? Or, is did he broker the real estate purchase? If the nephew brokered the loan, he's probably no longer employed by the same company (if at all) due to the failure of the residential mortgage industry in California. You need to contact the lender directly (the person you make payments to) in order to request loan documents. Tell them that you never received copies, which is a RESPA and potentially a TILA violation. If your nephew brokered the home purchase, he probably never had the loan documents to begin with.
