Is a water tank 10' from property line on 40 acre parcel an enroachment?

Not in the usual sense of the word "encroachment," which means that Party X has installed something upon or is trespassorily making use of Party Y's land. If the tank is not in any part actually across the line, it would not ordinarily be thought of as an encroachment. However, it may be that the tank is sitting on an easement, or that it is not sufficiently set back from the property line as required by a local zoning-type ordinance. In such cases, the use of the term "encroachment" might be appropriate to describe the mis-placement of the tank.
