Legal Question in Real Estate Law in California

Real Estate

My sister-in-law was a responsible person until 2 years ago but now is on crystal meth. She and her new boyfriend have depleted all her financial resources except for her rented house (she has also stolen from her parents, which is how bad her situation has become). The house has rental income at the moment, and she has allowed us to take over paying the mortgage for her since she was 'blowing' the rent money, but we are afraid she will sell the house and use the money for drugs also. She is 37 yrs old. Is there anything we can do to keep the money if the house sells, until she comes 'clean'? She is already deliquent on the loan and has ok'd us receiving the rent check so we are paying the mortgage for her for now. We think we should sell the house before the bank takes it, can we keep the money out of her reach until she can get clean?

Re: Real Estate

Only if she agrees to making a trust or some other arrangement. It would be best to have a non-revocable trust so that she does not change her mind and end the trust. It is her house [check the title]; she has control over it.
