Legal Question in Real Estate Law in California

Responsibility for destruction of Property?

Is a person in any way responsible for destruction of property at a hotel that he did not do and was not even present when it was done, but their name/identity was stolen and used by unknown persons to stay at hotel. Where does the burden of proof lie, with hotel or falsely accused individual? Is there a statute of limitations for suit?
