Legal Question in Real Estate Law in California

Rommate won't return deposit

I moved from my apartment 2 months ago and my roommate has only given refunded me 1/2 of the deposit owed to me. He now states that he will not give me the rest until I sign an agreement stating that I will not request any further monies if and when he moves from the apartment. I advised him that I would sign the agreement once I receive the check and it clears, but he won't give me what is rightfully mine. In addition, I am receiving derogatory emails from him regarding our previous relationship. I want to know what I can do to get my money back and stop this harassment from him. (I have copies of the emails.)

thanks!
