What needs to be done is to commence an Unlawful Detainer Proceeding. A 30-day Notice to Quit must be served on the property and all tenants. After it's expiration if the tenants still fail to move out. A Complaint for Unlawful Detainer (Eviction) would have to be filed.

Our firm would be glad to handle this type of matter for you. Please contact our office and speak to either myself or John F. Alarcon.

Thank you

You have a right to evict any persons living in your new property. You may wish to establish a rental agreement or just have them leave. You need to consider what it is you want to do. If it is to move in yourself, you will probalbly need a local attorney to handle the eviction process. Normal fees for this range from $250 to $400. Please feel free to contact me at 408-205-5100, I have an office near Loma Linda hospital and handle evictions in the San Bernadino and Riverside Courts.
