Legal Question in Sexual Harassment in California

Do I have a case

I work at a diner and I am having problems at work with my cook that I work with. He has been saying things like he is my future husband and he tells my other co workers that he is in love me and when the other workers talk to me he tells them not to because he gets jealious and at first I did not think any thing of it. Even though it bothered me and I told my manager that I was unconfortable she said that it was just playing around. She said that is was cute.

If your employer fails to remedy this problem, they could be liable for hostile work enviroment harassment. Be sure to document all contact with your supervisor concerning this issue and make a record of incidents. You may have to go to the EEOC if no remedy. Be advised, however, the squeaky wheel sometimes gets illegaly greased (fired) in these situations. If want further help call me at 805/641-6600.

Thanks for your inquiry. I must concur that the key here is to document your complaints regarding this with management. Deliver a letter to management, and keep a copy, or ask for a note to be inserted in your file regarding your complaints.

If you are fired, demoted, subject to discipline or harassment at work because of your complaints, then you may have a much different case than the one you described, for legal reasons.

Classic sexual harassment and hostile workplace. The company is obliged to remedy, and liable if they don't. The only issue is case value, determined by how outrageous the situation. Contact me if interested in pursuing.
