Legal Question in Sexual Harassment in California

Define Hurassment

If there are two waitresses at a Restaurant, and an Male employee is going around saying he had sex with them, which is a lie. Is this Harassment? They reported it to the Supervisor and he said NO??? One lady is married and the other is a young lady. He had mentioned this to numerous Employes and people.???

It can also be defamatory -- i.e. slander -- especially if the women are married, since it implies their lack of chastity.

This may very well be actionable harassment, particularly because it was reported to the Supervisor and he has not done anything to remedy the situation. If the harassing employee is a co-worker, then the harassment generally must be reported to the employer and they must fail to act before the company is liable.
