Legal Question in Sexual Harassment in California

illegal sex tapes

Is it illegal to video tape someone when you are trying to have sex with that person if they don't know about it especially if both people are underage? And if so, what kind of charge would they get? And is it still illegal if that person tried to get it on tape but that person didn't actually have sex?

Both of you are underage? You bad, naughty kids. Secretly videotaping your sex partner of any age, or your would-be sex partner, will get you arrested and/or sued; unless she is famous, in which case you might get rich selling the tape, enabling you to hire a good lawyer when you are eventually arrested and sued. And there is always the possibility that you will be so distracted trying to get it all on tape that you won't pay attention to her, she will lose interest, and you won't be successful in your quest to have illegal underage sex. You could be charged with producing child porn, which is a lot more serious of a rap than puppy love.

If you indeed have footage of young love unrequited you had better burn it before it gets posted to YouTube and, at best, everyone has a good laugh at your expense.
