Legal Question in Sexual Harassment in California

my regional manager sent me an e-mail that says "i woke up with a massive hard-on this morning, what shgall I do?" and then sent a pic of himself from the waist down?

I would suggest that you give a copy of everything to the person(s) designated by the company to handle discrimination and sexual harassment claims. Do NOT delete the e-mail, and forward a copy to your personal address for safekeeping. If they do nothing after a reasonable time, you might pursue your legal remedies, including filing a claim of sexual harassment with the California Department of Fair Employment. It's bad enough when a direct supervisor does something idiotic like that. It's worse when it's the regional manager!

Mr. Cohen gives sound advice. Workplace sexual harassment only becomes actionable when the employer fails to remedy it. So you have to give them a chance to fire this guy before you would have a chance of winning a lawsuit about it.

I look at things a little differently. First, sit down and think about how you feel working there. Can you continue to work there? Also, is there a pattern of this? Have you reported problems like this before? Do you need him to be fired or transfered to continue working there? You need to decide what you want. If you feel you cannot work there, or that there is no way to remedy the problem, or that he is too high up to face consequences, you should contact myself, or another attorney, and we can seek relief for you or document the issue properly and work with the company to remedy the problem.
