Legal Question in Sexual Harassment in California

Sex Catalog

Can a employee get fired for looking at a catalog, off the clock, that has nighties and sex items in it? I brought in a gift at work to give to a friend that does not work there and someone got into the bag without my permission and told people what it was. It was a top and thong outfit. Can I get in to trouble even if it was 6 months ago?

Re: Sex Catalog

Does the employer have a published policy? If yes, the policy will describe what conduct is unacceptable in the work place. If the catalog remained in your bag and was not visable in the work place - generally that would not constitute unlawful harassment. The person who told others about it may have violated some employer's policies.
