Legal Question in Sexual Harassment in California

Is this sexual harrassment?

We were recently on a cruise where one of the female crew members made advances to my husband by kissing him and giving him her contact information. He wrote a letter to the cruise line to complain but they say that there is only sexual harrassment in an employment situation. They claim they took action but won't tell us what they did do to privacy. Do we have any rights?

Re: Is this sexual harrassment?

Thank you for your posting.

Do you have any rights? Well, you have the right to complain, as you have availed yourself of. You have the right to vote with your pocketbook and boycott this cruise line. But you have not mentioned the case for sexual harassment damages. What out of pocket expenses would you ask a court to award? The cruise line is correct, that sexual harassment, typically, is only in the employment context. However, your husband may sue for battery or something similar, but I really doubt that the additional headache of a lawsuit would justify a kiss and a contact information exchange.

I hope this information helps, but if you do have any other questions, want more information regarding any part of my answer, or feel that you need legal representation, please feel free to email me directly at [email protected]. Im happy to help in any way that I can, and best of luck.
