Can I sue?

I was sexually harrassed at work. I have many witnesses and I recently quit because of it. Can I sue the company or the manager? If so what can I sue for? Am I only entitled to lost income because of the quit or can I sue for other things?

A victim of sexual harassment can sue for economic losses, medical costs for treatment necessitated by the harassment, compensation for emotional distress, pain, suffering, humiliation and embarrassment. In addition, the defendants are liable for punitive damages and your attorneys fees. You should file a complaint with the nearest office of the Dept. of Fair Employment and Housing, or consult an attorney in your area.

Yes, you can sue and collect back pay, punitive damages, emotional distress, etc.

There are some very strict laws against sexual harrassment and discrimination based on sex, both at the state and federal level. I am involved in two of these now.

If the Company knew of the sexual harassment and you made it clear that you were quitting because they did nothing about it then you can sue, collect back wages, possibly future wages, and emotional distress and sometimes punitive damages.

Before you file suit however, you must file a claim of sexual harassment with the Department of Fair Employment. They have a office in Oakland and you can reach them at 800-884-1684.

You should also consult with a local attorney who can advise you on whether direct negotiatons might yield a quicker result.
