Legal Question in Sexual Harassment in California

workplace harassment and divorce

i believe my wife was harassed into an affair that is leading to the break-up of the marriage. do i have any claim against her employer. she is totally defensive of her job and the person she is having the affair with, to the point of denile.

Dear Husband:

Under California law there is no "case" [viable theory of recovery] under the facts you provided. Many years ago and today in a few other states [not California] a theory called "Alienation of Affection" allowed a suit against the "other guy" or "girl."

From your analysis, it appears that the relationship at work is very important to your wife.

Not being rude nor trying to inject humor, perhaps you should seek professional help/counseling so that you can get a hold of your true feelings. You seem to be in a "punishment mode" rather than seeking a solution to the problems that you now or may shortly face, i.e., legal and emotional.

You cannot sue for alienation of affection.
