Legal Question in Social Security Law in California

SSI status & medical coverage jeopardy

My friend who has panic disorder & is on SSI and MEDICAL has the possibility of getting a wrongful death settlement. She is worried that accepting the settlement would jeopardize not only her SSI status but also her MEDICAL benefit. Can you let me know what the real threat is? She is willing to pay for advice.

Yes if she is receiving Supplemental Security Income (SSI) any and all assets will be counted against her. She cannot have more than $3,000 in the bank or in assets. Since SSI is based on economic need as well as disability it will affect her SSI. She will have to exhaust the funds until such time as she no longer has cash or a bank account showing more that that amount mentioned above. It is a difficult situation as they will terminate her benefits and she will have to reapply. There is no guarantee that she will automaticially be put back on.
