Legal Question in Social Security Law in California

widows benefits

my husband of 12 yrs was killed in car accident nov/06.after 35 yrs as an hourly employee with his father in family owned business and serving in US Army,when requesting burial assistance from SS Administration I was informed that my husband had''0'' money in his SS account,.(?) I was told to file for widows benefits on unrealized earnings. How do I start this proceedure and it this the right avenue to take?His father always assured us he was taking the correct deductions from his weekly check, and he won't allow me access to any records regarding my husbands employment to me. I don't know how to handle this issue now. Thank you for any help.

If proper deductions were taken, AND taxes were paid thereon, there should be more than 40 quarters available to qualify him/you for benefits under Title II.

The part that makes no sense here is that you're invited to apply for widows benefits in one hand when they're telling you he's got '0' in his account.
