Legal Question in Tax Law in California

New marriage, tax intercept

My new husband owes back child support and has no income. I have all the income and our refund was intercepted to pay his back child support. Is there anything I can do since I had nothing to do with this very old case? I'm happy to help if I can but my 17 year old daughter was killed in an accident last year and I am in financial difficulty because of the trauma and need every penny I can get right now.

first, consult with your tax return preparer to determine whether or not to file separate tax returns in future years.
