Legal Question in Traffic Law in California

My brother and his girlfriend (Who works at the police station) Used my information when getting pulled over and got two tickets on my license...I had no knowledge of the tickets at ALL! Now out of the blue I'm just finding out that my license has been suspended since JANUARY of this year! It says in the system that I was not notified that my license was suspended as well.The tickets they got also went into collections and my stupid brother set up a payment plan and was paying down on the tickets he got under my name...How do I fix this? How do I get my license back? My job depends on me having my license in good standing and now I find out that my brother stole my identity. Will it take long for them to reinstate my license? Will my brother and his girlfriend be charged with fraud? Will I still have to pay for the tickets THEY got?

You can do it yourself or retain an attorney to assist you. The first step would be to contact the law enforcement agency that issued the ticket and report the use of false name for the ticket. Many law enforcement agencies have the person receiving the ticket put a thumb print on the ticket. If that does not work then retain an attorney to prepare a motion to correct the judgment. File the motion and request that the court set aside the judgments and dismiss them. The process would go faster if your brother was to go to court with you and admit that he is the one that received the tickets. This will result in his being prosecuted for presenting false identification.
