Legal Question in Traffic Law in California

Driving on a Suspended License

While driving on a suspended license, for the second time, is there any Mercy from the Court that might or could be granted if there was substantial evidence to show that individual had a good cause for driving.

Thank you.

Re: Driving on a Suspended License

Thanks for your inquiry. If you have legal or factual defenses to the charges, you should try those first. If your attorney is convinced that you have none, then you will want to mitigate your damages in this case by trying to obtain a license. The reasons why you had to drive might be a factor in lowering your sentence, but if you have an emergency situation that required you to drive to avoid harm to yourself or others, then you may have the defense of necessity, which is worth arguing.

I apologize for the slight legalese in my response, but I do wish you luck, and I hope this helps. Of course, if you have any other questions, please feel free to email me directly. Thanks.

Re: Driving on a Suspended License

The court most likely will not see a no good reason for you to drive on a suspended license. Especially is this is your second offense. Why is your license suspended? You should try and mitigate your problem by getting a valid license. Please contact my office at 310/277-1707 so that we may discuss your legal options.
