Legal Question in Traffic Law in California

Insurance and Tags

I got ticketed for expired tags and no insurance. I recently purchased the car and had registered at DMV and was told it was Ok to drive while the new tags were on it's way. But I could not insure the car until the registration process was complete and was also under the impression that the car was still covered by the previous owner. One interesting thing, on the ticket, the officer put the correct code for the tags (4000aVC) but put its description as "Speed". What can I do or what can happen?

Re: Insurance and Tags

This kind of mistake can and should get the ticket dismissed. When you go to court tell the judge that because of the ambiguity on the ticket you are unsure of what you are being charged with and your due process rights have been violated. You have not had adequate notice of what you are being charged with and therefore have not been able to prepare for your defense. Unless the judge is a total whore, he should dismiss the charge.
