I was charged with vc23111, throwing a lit substance from my vehicle. I ''flicked'' my ashes out the window but I did not throw anything from my vehicle. Is flicking my ashes out the window considered throwing a lit substance from my vehicle?

I doubt that the court will see a difference between the ash and the possibility of a hot ember being dropped off the end of the cigarette.
