Adoption required?

We have a ''son'' that is not legally ours. Can he inherit money tax free from our living trust if he is named in the trust or does he need to be adopted to get the inheritance tax free?

Estate tax is based on the size of the estate, not the relationship of the beneficiary. This year, the individual exemption from federal estate tax is $3.5M.

Moreover, if the trust is designed properly it may be able to take care of your son in sickness and in health.
