Legal Question in Wills and Trusts in California

need advice for distribution of my funds

I have two children. Child #1 has no children and no legal spouse. Child #1 is the beneficiary on the majority of my funds. Child #2 has an ex-wife and one minor child. Child #2 is in prison for the next six years.Will the state take the funds I leave to child #2? If so how can I leave this child funds that the state cannot take from him as he will need it to start a new life when released. Child #1 and I sometimes travel together. If we perished together, who would get the funds I have designated to him? Would they go to child #2 or would they go to his father from whom I am divorced and do not wish him to have it? I do not have a lot of money to spend on wills, etc.

You need to sit down with an attorney to determine if you need a trust. You may also want to establish a trust for the minor grandchild.
